Prime Impact Basketball: Terms & Conditions

Effective Date: October 2, 2026

These Terms & Conditions (“Terms”) govern your participation in the programs, services, sessions, runs, clinics, camps, and events offered by Prime Impact Basketball (“we,” “our,” “us,” or the “Program”). By enrolling in, purchasing a ticket to, registering for, accessing, or participating in the Program, you agree to these Terms on your own behalf and on behalf of any minor athlete you register.

Please read Sections 7 and 8 carefully. Section 7 is a release of liability and assumption of risk. Section 8 is a media release that grants Prime Impact Basketball permission to photograph and record your athlete and to publish that content. By registering or purchasing a ticket you are agreeing to both.

1. Recurring Payments

  • Monthly payments are billed on your assigned start date.
  • Cancellation requires at least 14 days’ notice before your next billing date; otherwise you will be charged for the upcoming cycle and then removed from the Program.
  • Rejoining after cancellation incurs a $75 re-registration fee.
  • An additional $50 monthly administrative fee applies if you opt out of recurring payments.

2. Attendance & 24-Hour Notice

A minimum of 24 hours’ notice via call or text is required if an athlete cannot attend a session. With notice, you may reschedule. Day-of cancellations will count as a used session.

3. Reschedules & Makeups

Each athlete may reschedule or make up up to 2 sessions per month. Requests are subject to availability.

4. No Refunds Policy

All payments are final. No refunds, returns, or exchanges are offered for services, tickets, or products. Enrollment or ticket purchase confirms acceptance of this no-refund policy.

5. Conduct Rules

No Recruiting

Soliciting players for other teams or programs is prohibited and may result in dismissal without refund.

No Sideline Coaching

Parents and spectators must not interfere with coaching during sessions.

Training Groups

Groups are formed by skill, age, and availability. Focus on personal development rather than comparisons.

Removal

We reserve the right to remove any participant, parent, or spectator whose conduct is unsafe, disruptive, abusive, or in violation of these Terms. Removal for cause does not entitle you to a refund.

6. Arrival & Departure

Sessions are 60 minutes unless otherwise stated. Please coordinate pick-up and drop-off times accordingly. Do not dribble or use the court until your session begins. Athletes must be collected promptly at the end of a session. We do not provide supervision before or after scheduled session times.

7. Liability Waiver & Assumption of Risk

Participation in basketball training carries inherent risks, including but not limited to sprains, strains, fractures, concussions and other head injuries, dental and facial injuries, heat illness, cardiac events, permanent disability, and death, arising from falls, collisions, physical contact, court conditions, equipment, or the conduct of other participants. You voluntarily assume all such risks, whether known or unknown.

To the fullest extent permitted by Texas law, you release, waive, discharge, and covenant not to sue Prime Impact Basketball and its owners, directors, officers, employees, coaches, volunteers, contractors, and facility providers from any and all claims, demands, damages, or causes of action arising out of or related to injuries, damages, or losses sustained in connection with participation, travel to and from sessions, or presence at any facility, whether caused by negligence or otherwise, except for willful misconduct or gross negligence.

You agree to indemnify and hold harmless the parties named above against any claim brought by or on behalf of your athlete arising from participation, to the extent permitted by law.

It is your responsibility to ensure your athlete is physically able to participate and to disclose any relevant medical conditions before the first session. You authorize us to secure emergency medical treatment for your athlete if you cannot be reached, and you accept financial responsibility for that treatment.

This section applies to every program, session, run, clinic, camp, and event, including ticketed events, and survives the end of your enrollment.

8. Media Release & Consent to Use Likeness

In plain terms: we photograph and film our sessions, runs, and events. By registering or buying a ticket, you are giving us permission to use that footage of your athlete in our social media, emails, website, and advertising, at no cost to you and without needing to ask again each time.

8.1 Grant of rights

By enrolling in, registering for, purchasing a ticket to, or participating in any Prime Impact Basketball program, session, run, clinic, camp, or event, you grant to Prime Impact Basketball and its owners, employees, coaches, contractors, marketing and advertising partners, successors, and assigns (together, the “Authorized Parties”) the irrevocable, perpetual, worldwide, royalty-free, fully paid, non-exclusive right and permission to:

  • Photograph, film, video record, audio record, and livestream you and your athlete during any session, run, clinic, camp, event, team activity, or visit to a training facility;
  • Use, reuse, publish, republish, reproduce, edit, crop, resize, caption, overlay, combine with other content and music, and create derivative works from those photographs and recordings;
  • Use your athlete’s first name, image, likeness, voice, performance, jersey number, age, general location, school or team affiliation, and athletic progress in connection with that content;
  • Distribute and display that content through any medium now existing or developed in the future, including social media platforms, our website and client portal, email campaigns, text messages, paid advertising on any platform, print materials, signage, broadcast, podcasts, highlight reels, and promotional merchandise; and
  • Sublicense and assign these rights to marketing agencies, media partners, and advertising platforms acting on behalf of Prime Impact Basketball.

8.2 No compensation

You acknowledge and agree that neither you nor your athlete will receive any payment, royalty, residual, or other compensation for any use described above, now or in the future. You agree that participation in the Program is good, adequate, and sufficient consideration for this grant.

8.3 No right to inspect or approve

You waive any right to inspect or approve the finished photographs, recordings, edits, captions, advertising copy, or the use to which any of it may be applied.

8.4 Release of claims

You release, discharge, and hold harmless the Authorized Parties from any and all claims, demands, and causes of action arising out of or related to the capture, use, publication, or distribution of such content, including without limitation claims for defamation, invasion of privacy, false light, misappropriation, infringement of the right of publicity, infringement of moral rights, emotional distress, or any claim based on blurring, distortion, alteration, optical illusion, cropping, editing, or use in composite or altered form, whether intentional or otherwise.

8.5 Parent and guardian consent for minors

If the athlete is under 18 years of age, the person completing registration or purchasing the ticket represents and warrants that they are the parent or legal guardian of that athlete and hold full legal authority to grant this release on the athlete’s behalf. That person grants this release in both their individual capacity and on behalf of the minor athlete, and agrees to be bound by it personally. No image, recording, or identifying information of a minor will be published without a consent meeting this requirement, and completion of registration constitutes that consent.

8.6 No expectation of privacy during sessions

Sessions, runs, and events take place in shared athletic facilities where photography and recording occur routinely. You acknowledge that neither you nor your athlete has a reasonable expectation of privacy during any session, run, clinic, camp, or event, or in any common area of a training facility.

8.7 Opting out

If you do not wish your athlete to be photographed or recorded, you must notify us in writing at [email protected] before your athlete’s first session or event, and you must identify the athlete by full name. An opt-out:

  • Applies on a going-forward basis only;
  • Does not require the removal, recall, or deletion of content already created, published, distributed, or placed into advertising;
  • Does not apply to incidental or background appearances in wide shots, crowd shots, or group footage where the athlete is not the subject; and
  • Does not affect footage already licensed or supplied to a third party.

We will make reasonable efforts to honor an opt-out but cannot guarantee that an athlete will not appear incidentally in group footage.

8.8 Recording by others

Other participants, parents, and spectators may photograph or record sessions and events. Prime Impact Basketball does not control, authorize, or take responsibility for recordings made by third parties, and this release does not grant rights to any third party.

8.9 Survival

This media release survives the end of your enrollment, the expiry of any ticket, and the termination of these Terms, and continues to apply to all content captured during the period of participation.

9. Events, Runs & Ticketed Sessions

Friday Night Run and other ticketed events, clinics, and camps are governed by these Terms in full, including the liability waiver in Section 7 and the media release in Section 8.

  • Tickets are final sale. Tickets are valid only for the specific date purchased and are not transferable to another date, event, or participant unless we agree in writing.
  • Age and ability requirements are stated on each event listing and are enforced at the door. Athletes who do not meet the stated age range or who cannot dribble, shoot, and complete a layup may be unable to participate, without refund.
  • Capacity is limited and stated on each listing. Spots are allocated in order of completed payment.
  • Facility address is released after payment.
  • We may reschedule or cancel an event for weather, facility availability, staffing, or safety. If we cancel outright, we will offer a credit toward a future event.

10. Eligibility & Health

You confirm that your athlete is in good physical condition and has no medical condition that would make participation unsafe. You must disclose allergies, asthma, prior concussions, cardiac conditions, and any other relevant condition at registration and update us if anything changes. We may require a physician’s clearance before permitting participation.

11. Electronic Acceptance

Completing an online registration, submitting a form, purchasing a ticket, or checking a box indicating agreement to these Terms constitutes your electronic signature and creates a binding agreement with the same legal effect as a handwritten signature. We retain a record of the date, time, and account used to accept these Terms. These Terms may be updated from time to time, and the version in effect on the date of your registration or purchase governs that transaction.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your participation shall be brought exclusively in the state or federal courts located in Denton County, Texas, and you consent to the jurisdiction of those courts.

If any provision of these Terms is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

You can manage cookies through your browser settings, though some site features may not function correctly if cookies are disabled.

8. Your Rights (Texas)

Under the Texas Data Privacy and Security Act, Texas residents have the right to confirm whether we are processing their personal data and to access that data, to correct inaccuracies, to request deletion, to obtain a portable copy, and to opt out of the processing of personal data for targeted advertising, the sale of personal data, or certain profiling. To exercise any of these rights, contact us using the details in Section 11. We will respond within the timeframes required by law, and you may appeal a decision by replying to our response.

9. Security & Retention

We implement reasonable administrative, technical, and physical safeguards to protect personal data. We retain information only as long as necessary for our business purposes and legal compliance. Photographs and recordings covered by the media release may be retained and used indefinitely, as described in Section 8.

10. Children’s Privacy

Our programs serve minors, and we collect information about athletes under 18 from their parents or legal guardians. We do not knowingly collect personal information directly from a child under 13 without verifiable parental consent. Registration, ticket purchase, and any submission of a minor’s information must be completed by a parent or legal guardian, who thereby provides that consent.

A parent or guardian may review the personal information we hold about their athlete, request its correction or deletion, and refuse further collection, by contacting us using the details in Section 11. Deletion requests relating to published photographs and recordings are subject to the limitations in Section 8.7.

11. Changes & Contact

We may update this Privacy Policy. Any changes will be posted with an updated effective date, and the version in effect at the time of your registration or purchase governs that transaction.
